Family Dispute Resolution (FDR)

Supporting Families to Resolve Disputes Respectfully and Constructively

Family Dispute Resolution is a specialised form of mediation, guided by the principles of the Family Law Act 1975, that helps separated families resolve disputes about parenting and financial matters. The process is facilitated by a registered Family Dispute Resolution Practitioner (FDRP) who remains impartial while helping both parties express their needs, clarify misunderstandings, and explore solutions. 


In many cases, FDR is a mandatory step before applying to the Family Court for parenting orders, unless an exemption applies.

As accredited FDR practitioners, our role is to: 

- Provide a neutral, balanced space for discussion. 

- Assist both parties to listen and be heard. 

- Guide the process with structure and fairness. 

- Help document agreements in writing, where possible. 

- Issue s60I certificates when required for court proceedings. 


How the Process Works 

1. Initial Assessment – We assess whether FDR is appropriate and safe for all parties. 

2. Intake Interviews – Individual confidential sessions to understand needs and concerns. 

3. Joint FDR Sessions – Guided discussions focused on resolving the issues at hand. 

4. Agreement Recording – Support to draft parenting plans or outline financial understandings. 

5. Follow-Up or Court Referral – If no agreement is reached, we can issue a s60I certificate for court application.

Martina has lived and breathed the legal industry for more than 30 years. Known for her empathetic yet strategic approach, Martina is dedicated to helping individuals and families navigate separation, divorce, parenting matters, and property settlements with clarity, confidence, and compassion.


Before establishing Next Chapter Legal Services, Martina was a senior practitioner at Smythe Wozniak Lawyers, where she earned a strong reputation for her practical advice and client-first mindset. She has acted in a wide range of complex family law matters, including high-conflict parenting disputes, simple and complex financial settlements involving family businesses, and urgent applications in the Federal Circuit and Family Court of Australia.


Martina founded Next Chapter Legal Services Pty Ltd with a vision: to create a modern, client- focused law firm that supports people through life’s most difficult transitions and empowers them to move forward with strength and dignity. She believes in making the legal process as transparent and stress-free as possible, with tailored solutions that reflect each client’s unique circumstances.
